Using Spotify in your business
The answer to the question, "Can I use Spotify business?" is
No.
But why not?
Spotify is a music provider set up for the consumer market. This means that Spotify does not pay the appropriate royalties to be able to use the service for business purposes. So Spotify is not for businesses, but for private use.
But I pay the Buma/Sena, don't I?
Yes, that is true.
As soon as you use music in your business, you pay Buma/Sena for making the music public. It does not matter what source of music you use (radio, CD, computer, etc.) and whether the music is used for commercial or non-commercial purposes. (Radio, CD, computer, etc.) and whether the music is used for commercial or non-commercial purposes.
In short, you pay disclosure rights.
The amount that you have to pay Buma/Sena for publication rights is determined by the number of square metres where the music is played and which sector your business falls under.
What else do you have to pay?
For the use of commercial music in your business, you have to pay reproduction rights.
The reproduction rights fee is NOT paid for business use with a Spotify subscription. This is because Spotify is a consumer streaming service. With a business streaming service, these fees are included in your subscription.
If you use Spotify in your business, you are legally in violation and risk a large fine if Buma/Stemra or Sena check.
In short,
Do you want to play commercial music in your business, company or association? Then it is best to use a business streaming service, such as BCM Stream. We pay the reproduction rights, so you only have to pay the publishing rights. This way, artists get a fair remuneration and you don't risk any fines. Win-win right?
